Terms of Service

Effective date: July 11, 2025

These Terms govern your use of Snap Banquet (“we,” “our,” or “the Service”). By using Snap Banquet in any capacity, you agree to these Terms. If you do not agree, do not use the Service.

🔒

The short version: Your photos belong to you. Your guests' photos belong to them. We store them securely, keep them private to your event, and delete them automatically after 180 days. We never sell your data or use photos to train AI. We just run the camera app.

1.Who We Are and What We Do

Snap Banquet is a software-as-a-service platform that enables professional photographers (“Studio Partners”) to offer a branded, disposable-camera experience to their event clients. Guests at events scan a QR code and take photos through a web browser — no app download required. Photos appear in a live, private gallery branded with the photographer's logo.

Snap Banquet is operated by its founders (“we,” “us,” or “Snap Banquet”). Questions about these Terms can be directed to hello@snapbanquet.com.

2.Who These Terms Apply To

These Terms apply to all three types of people who interact with our Service:

  • Studio Partners — Professional photographers who subscribe to Snap Banquet to offer the branded camera experience to their clients. Studio Partners create accounts, pay subscriptions, and are responsible for their events and clients.
  • Event Clients — The couples, companies, or individuals who hire a Studio Partner. Clients may access a private event portal via a secure link provided by their photographer. No account is required.
  • Guests — People who attend an event and use the Snap Banquet camera via a QR code. Guests do not create accounts. They interact with the Service anonymously through a session tied to their device.

Different sections of these Terms apply to different user types. We'll note this clearly where relevant.

3.Studio Partner Accounts

Eligibility. You must be at least 18 years old and a professional photographer or event service provider to create a Studio Partner account. By creating an account, you represent that all information you provide is accurate and that you have authority to enter into this agreement.

Account security. You are responsible for keeping your password confidential. Snap Banquet is not liable for any loss or damage from unauthorized access to your account caused by your failure to protect your credentials. Notify us immediately at hello@snapbanquet.com if you believe your account has been compromised.

Accurate information. Your business name and logo must accurately represent your business. You may not impersonate another photographer or business.

One account per person. Each Studio Partner subscription covers one photographer's account. Multiple photographers at a studio each need their own account.

4.Subscription and Payment

This section applies to Studio Partners only.

Subscription. Access to Snap Banquet's Studio Partner features requires a paid monthly subscription. Pricing is displayed at signup and on our pricing page. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

Event limits. Each subscription plan includes a set number of events per billing period (counted from your subscription start date, not the calendar month). Creating more events than your plan allows is not permitted. Unused events do not roll over.

Payment processing. All payments are processed by Stripe. We do not store your credit card number. By subscribing, you also agree to Stripe's Services Agreement.

Cancellation. You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of your current billing period. You retain access to all features through the end of that period. We do not offer prorated refunds for partial months.

Failed payments. If your payment fails, we will attempt to charge your payment method again. After repeated failures, your account will be downgraded to inactive status. Your event data is retained during this period and restored when billing resumes, subject to our standard retention policy.

Price changes. We will give you at least 30 days notice before changing subscription pricing. Continued use after the effective date constitutes acceptance of the new price.

5.Photo Ownership and License

This is the most important section for guests and photographers. Read it carefully.

Guests own their photos. Any photo taken by a guest through Snap Banquet belongs to that guest. We claim no ownership over guest-created content.

License you grant us. By taking a photo through Snap Banquet, each guest grants Snap Banquet a limited, non-exclusive, royalty-free license to: store the photo on our servers; display it within the event's private gallery; and allow authorized viewers of that event (other guests, the event client, and the Studio Partner) to view and download it. This license is strictly limited to the event the photo was taken at and expires when the photo is deleted.

Studio Partners do not own guest photos. The Studio Partner's logo appearing in the app does not grant them ownership of guest-taken photos. Studio Partners may download photos for delivery to their clients, but may not use guest photos for commercial purposes (marketing, stock photography, etc.) without obtaining separate consent from the photographer (the guest).

No AI training. We do not use photos taken through Snap Banquet to train machine learning models, build facial recognition databases, or for any purpose other than providing the Service as described.

Your logo and brand assets. Studio Partners retain all ownership of their uploaded logos and branding. By uploading a logo, you grant us a license to display it within the app surfaces associated with your events. We do not use your logo for any other purpose.

6.Photo Privacy and Event Access

Events are private by default. Every event gallery is accessible only via a unique QR code or direct link. Galleries are not publicly indexed, do not appear in search engines, and are not visible to anyone without the specific link or QR code for that event.

Who can see your photos. Photos you take at an event are visible to everyone with access to that event's gallery link — meaning other guests at the same event, the event client, and the Studio Partner. By taking photos and submitting them to the gallery, you consent to this shared visibility within the event.

Moderation. Studio Partners and event clients can hide or remove specific photos from the gallery view. Hidden photos remain in our system (accessible only to the Studio Partner) until the retention period expires or are permanently deleted upon request.

Requesting removal of your photo. If you are a guest and want a specific photo of you removed, you may contact the Studio Partner who organized the event, or contact us directly at hello@snapbanquet.com with the event name and a description of the photo. We will process removal requests within 5 business days.

7.Data Retention and Deletion

Automatic deletion after 180 days. All photos and event data are automatically and permanently deleted 180 days after the event date. This deletion is irreversible. Studio Partners should download any photos they need to retain before this date.

Manual deletion. Studio Partners may delete individual photos, entire events, or their account at any time. Deletion is permanent and cannot be undone.

Account closure. When a Studio Partner closes their account, all associated events, photos, and personal data are permanently deleted within 30 days, except where we are required to retain certain records for legal or tax purposes (such as billing records, which are retained for 7 years as required by law).

8.Acceptable Use

You may not use Snap Banquet to:

  • Upload, take, or share photos that are sexually explicit, violent, harassing, or illegal under applicable law
  • Capture, share, or store any content depicting the sexual exploitation of minors (CSAM) — any such content will be reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement immediately
  • Impersonate any person or organization
  • Use the Service to spy on, photograph, or record individuals without their knowledge at non-public events
  • Reverse-engineer, scrape, or attempt to circumvent any technical measures of the Service
  • Use the Service for any purpose that violates applicable laws
  • Create multiple accounts to circumvent plan limits or a prior suspension

We reserve the right to remove any content that violates these Terms, suspend accounts engaged in prohibited conduct, and report illegal content to the appropriate authorities without prior notice.

9.Studio Partner Responsibilities to Guests

Studio Partners are responsible for ensuring that guests at their events understand that photos taken through Snap Banquet will be visible to all event attendees in a shared gallery. We recommend that Studio Partners:

  • Display or communicate to guests that a shared digital camera is in use at the event
  • Inform clients that photos appear in a semi-public (within the event) gallery
  • Exercise their moderation tools to promptly address any inappropriate content

Studio Partners represent that they have the right to deploy Snap Banquet at any event they create on the platform, and that doing so complies with applicable laws in the jurisdiction where the event takes place.

10.Age Requirements

Account holders must be 18 or older. Studio Partner and Event Client accounts require users to be at least 18 years old.

Guests. The guest camera experience (scanning a QR code and taking photos) is designed for use at private family events like weddings and parties where guests of all ages may be present. Children may use the camera with parental supervision and implied consent from parents/guardians who brought them to the event. We do not knowingly collect personal information from children under 13 — the only data stored from a guest session is an anonymous device identifier and the photos themselves. No name, email, or contact information is collected from guests.

11.Service Availability

We work hard to keep Snap Banquet available and reliable, especially during events. However, we cannot guarantee 100% uptime. The Service is provided “as is” and we make no warranties that it will be uninterrupted, error-free, or suitable for any particular event.

Important for events: We strongly recommend that Studio Partners inform their clients that Snap Banquet is a supplementary photography experience and should not replace professional photography at important events. Snap Banquet is not a substitute for professional photography.

We will make commercially reasonable efforts to notify Studio Partners of planned maintenance windows in advance.

12.Intellectual Property

The Snap Banquet name, logo, software, website, and all associated intellectual property are owned by Snap Banquet and protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works of our platform without our written permission.

We respect others' intellectual property rights. If you believe any content on our platform infringes your copyright, please send a DMCA notice to dmca@snapbanquet.com including: identification of the copyrighted work; identification of the infringing material and its location; your contact information; a statement of good faith belief; and your signature.

13.Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

14.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNAP BANQUET AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PHOTOS, LOSS OF REVENUE, OR DAMAGE TO REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

15.Indemnification

You agree to defend, indemnify, and hold harmless Snap Banquet and its operators from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you upload or submit through the Service; (c) your violation of any applicable law or third-party rights; or (d) any event you create using the Service and the conduct of guests at that event.

16.Termination

By you. You may close your account at any time through your account settings or by contacting us. For Studio Partners, cancellation of a subscription takes effect at the end of the current billing period.

By us. We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for: violation of these Terms; conduct that harms other users, third parties, or the Service; non-payment; or if we discontinue the Service.

Effect of termination. Upon termination, your right to use the Service ceases immediately. Sections 5, 12, 13, 14, 15, and 18 survive termination.

17.Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify Studio Partners by email and update the effective date at the top of this page. Changes take effect 14 days after notice, unless a shorter period is required by law. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.

For non-material changes (such as clarifications or corrections), we may update the Terms without notice.

18.Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Informal resolution. Before initiating any formal legal proceeding, you agree to first contact us at hello@snapbanquet.com and give us 30 days to attempt to resolve the dispute informally.

Binding arbitration. If informal resolution fails, you and Snap Banquet agree to resolve disputes through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if eligible. You waive the right to a jury trial and to participate in a class action.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

19.General Provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snap Banquet regarding the Service.

Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.

No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
